Ban on plants with psychoactive substances

There are two 2020 drug tables with prohibited plants: the Plant List (Government Regulation No. 1002) and the Plant List (Government Regulation No. 934).

List No. 1002 is used most often and is used to determine penalties under Articles 228, 228.1, 229 and 229.1. That is, in situations where a person is accused of buying, storing, transporting, creating, selling, theft, extortion, or drug smuggling. Below is this drug table 2020.

List No. 934 is used only for Article 231, which provides for punishment for the cultivation of narcotic plants. The quantity in this case is calculated not by mass, but by the number of plants. For example, large size hemp – 20 plants, especially large – from 330; large size psilocybin mushrooms - 20 pieces, extra large - from 200 pieces. The calculation does not depend on the growth phase of plants.

Nuances of deciphering drug tables 2017

  • All mixtures, liquids, ethers, salts that include at least one prohibited substance are considered drugs.
  • If the drug is contained in a solution, then its weight is determined after drying.
  • Analogues of substances included in the 2020 drug table are also prohibited.
    Their production, storage, and sale are punishable. Trade names don't matter.

In addition to the given drug tables 2020, there is also a list IV. This is a list of precursors - substances that do not themselves act as drugs, but in a certain concentration are used for the manufacture of drugs. These include acetic anhydrite 10%, ethyl bromide 15%, acetone 60% and dozens of other components.

The circulation of such drugs is limited.
